VEMGO Seller Rules
Sellers are responsible for their inventory and transactions. VEMGO does not become the seller merely by hosting, reviewing, approving or promoting a listing. A different role applies only when VEMGO and the owner sign a separate written agreement that expressly appoints VEMGO.
1. Seller—not VEMGO
Unless VEMGO signs a separate written brokerage or consignment agreement, the listing owner is the seller. VEMGO supplies advertising, directory and marketplace technology and is not the owner, seller, buyer, dealer, auctioneer, inspector, shipper, guarantor or transaction agent.
2. Ownership and authority
The seller must own the item or possess valid written authority from the owner to advertise and sell it. The seller must maintain proof of ownership, title, invoice, manifest or authorization and provide it when requested.
3. Accuracy and required disclosures
The seller is responsible for accurate identity, contact information, photos, price, location, quantity, condition, mileage, hours, title status, liens, defects, recalls, authenticity, specifications and all other material facts. Stolen, disputed, counterfeit, nonexistent or misleading inventory is prohibited.
4. Legal sale and transaction responsibility
The seller is responsible for determining that the item may lawfully be sold and transferred and for permits, licenses, taxes, title work, bills of sale, delivery, export or import requirements, warranties, refunds, returns, chargebacks and buyer claims.
5. Buyer communications and safety
The seller must use truthful contact information and must not impersonate another person or company, divert buyers to fraudulent communications, or demand suspicious or unlawful payment methods.
6. Inspections and agreements
Sellers and buyers arrange inspections, video walkthroughs, payment, pickup, delivery and written purchase agreements directly. A VEMGO review, approval badge or document request is not an appraisal, inspection, warranty, title opinion or guarantee.
7. Cooperation and records
The seller must respond to reasonable verification or complaint requests and preserve transaction communications and supporting records. VEMGO may disclose records when legally required or reasonably necessary to investigate suspected fraud.
8. Enforcement
VEMGO may reject, hide, suspend or remove any listing or account, preserve related records, and refer suspected fraud or unlawful activity to payment providers or authorities. Approval does not waive these rights.
9. Rule updates and notice
VEMGO may update operational, safety, verification and moderation rules to protect buyers, sellers and the marketplace. Safety measures may take effect immediately. VEMGO will provide reasonable notice of material changes and may require sellers to accept an updated version before continuing to sell.
10. Seller responsibility for claims
To the fullest extent permitted by applicable law, the seller is responsible for claims, losses, costs or disputes arising from the seller’s item, listing, representations, conduct or transaction. Any indemnity or limitation of liability should also be included in attorney-reviewed Terms of Service.
Operational policy version: September 1, 2026. These rules are a safety control, not a substitute for attorney-reviewed Terms of Service, Privacy Policy, consignment agreements, tax advice or transaction documents. Texas counsel should review the final legal documents before payment processing or brokerage services launch.
